Exercise Two : Non-possessory claims

In addition to the publicly imposed limitations on the rights of real estate owners, the actions of private parties may also create limitations on property rights. Non-possessory claims refer to three basic type of limitations: easements, restrictive covenants, and liens. Easements involve the rights of use of a property for a specific purpose, such as access to an adjoining property. Easements are commonly given to utility companies for example, to install wires overhead or pipes in the ground. Restrictive covenants impose limitations on land use for future owners of a property. Also known as deed restrictions, restrictive covenants regularly occur in conjunction with the development of residential subdivisions.

However, the most common non-possessory claims are liens. Liens generally refer to the right of a creditor, such as a mortgage lender, to force the repayment of a debt through foreclosure and sale of a property. Liens can also include tax liens, which are a public limitation, and mechanic’s and materialman’s liens, which are the rights of those who provide labor and materials for the improvement to real property. Mortgage liens are most common and can be either purchase-money or non-purchase-money liens. The difference between these is discussed in the article Consensual Liens, provided by the Business Owners Toolkit. After reading the article, answer the following questions:

1.The term, “non-possessory” means that the debtor takes (or retains) possession of the property, and these claims apply to both real property and personal property. Give an example of a loan situation (not necessarily real estate) where the debtor would not retain possession of the property.

2.What is the difference between purchase-money and non-purchase-money liens? Give examples of each

    非所有權之權利指的是三項基本的限制:地役權、限制性公約及留置權

    地役權包含不動產供特定用途使用的權利,例如進入鄰近不動產的權利

    地役權通常供電力公司使用,例如到建築物周圍的土地裝置電路或管線

    限制性公約訂定未來不動產擁有者在使用上的限制

    也可稱為行為限制,限制性公約通常用於鄰近住宅區周邊小型土地的開發

    然而最常見的非所有權之權利是留置權

    留置權通常指的是債權人權利,例如抵押貸款債權人,可透過塗銷設定及出售不動產來確保債務得以獲得清償

    留置權也包含有稅務留置權,這屬於公共限制,技工及建材供料商的留置權指的是修建不動產時提供勞力及提供建材的人的權利

    抵押權留置權最為平常,可以屬於金錢買賣留置權或非金錢買賣留置權
