I think CN system use:

No trial without complaint (with the same mistake mixing the powers of prosecution (exec branch) and judicial.)

But I am not certain what TW uses - I bet it will be much more civilized.

I am no expert in legal systems; but I believe the legal system in Taiwan belongs to the Continental Law System, while the US belongs to the Common Law System.
