美國郵局包裹遺失,買家賣家責任的釐清??

有個問題想請問大家的意見,

有個澳洲的台灣留學生從奇摩拍賣跟我購買兩件皮衣寄到澳洲,因當時皮衣在美國,所以我請我美國朋友從美國透過美國郵局寄到澳洲,下標前我也告知買家運費是實報實銷,裝箱後的重量11.6磅,箱子大小16*16*6英吋,我當時報價是使用美國郵局Express Mail® International的快遞,不過運費102.25美金,後來買家決定使用Priority Mail® International寄出,運費79.6美金(這也有追蹤碼),運費確認後買家又討價還價只願意支付61.95美金,中間價差17.65美金我也接受我自己吸收。因運費實報實銷,我也問買家是否要購買保險,以免有遺失的風險,買家回覆是按照他自己的寄送經驗是不會有問題的,所以那件包裹就從美國寄出。

現在查詢那件包裹的追蹤碼,最後的狀態停留在7/9號芝加哥Processed Through Sort Facility,

就一直沒消息,買家也說沒收到貨,請美國郵局查詢需要24天才會有結果,我想詢問後續的處理問題??

假設最壞包裹遺失,對我賣家而言,我大概只想把郵局的賠償金退給買家?因為我爬文,有些包裹會流浪一兩個月買家才會收到,這包裹買家沒另外購買包險,賠償的肯定是不多,那兩件皮衣是台幣三萬八賣出,因我也沒收到皮衣,我也不太想全額賠對方,我知道這樣對買家可能不是很不公平,所以上來想請問各位,要如何做會比較好。

    Sorry you think too much.

    1. Your "tracking" number is not a really tracking number - a USPS tracking number starts with CJ is basically represents the Customs Form number.

    2. Since you have not purchased any insurance, USPS is not obligated to compensate your loss. In other word, you eat the loss. USPS is only responsible for refunding the shipping cost.

    Priority Mail package with Insurance will be assigned with a difference tracking number to make it traceable.

    s - In theory, you are correct.

    However, in actual real-life practice, sellers are responsible.

    It is entirely up to the seller to offer insurance and charge for it.

    s - one of the real-life example that you are wrong is Paypal.

    Paypal will allow chargeback as soon as the buyers did not receive anything, regardless of insurance.

    Insurance is used for protect the sellers, not buyers.

    Also - declining insurance does not mean waiver of liability as well.

    如果我是你, 我完全不會賠..你要多給他1元或100元, 那是你的決定... 我怕的是你如果太早說, 看你可憐, 讓你損失少一點, 他反而覺得你是不是有從中搞鬼.

    從你提供的資料來看, 怎麼寄, 要不要保險都是對方在決定. 東西已經交給美國郵局, 美國郵局搞丟東西也不是你的責任, 而你也並沒有失職導致美國郵局搞丟貨品...站在任何國家的法律角度, 你都是站的住腳的.

    如果美國郵局有賠償金退回給你, 當然你可以退給她, 但是想必金額很低. 最好的狀況是郵局最後找到了, 皆大歡喜. 否則, 這只能說是一個貪小失大的例子, 怎麼會有人寄這麼貴重的東西不保險? 保險又不會要多少錢.

    I don't think the seller is responsible in this case. According to the statment, buyer is the party pay the shipping charge and he decided how to ship and not to insure.

    It means, once the mercherdise hand over to the carrier, seller is no longer responsible for the lost.

    NO Gary, I believe I am correct in theory and pratical.

    It is clear, the buyer and seller has negoiated their payment amount, how to ship and all the details. According to the statment, the buyer decline to have insurance, and decided how to ship. It is buyer's choice, it is buyer's risk.

    No. I did consider paypal. However,

    1) this is "奇摩拍賣". It is not ebay

    2) paypal did mention in the question. Can't assume it apply.

    3) Paypal did not handle as you state " chargeback as soon as ". It still need to go through a process.

    4) Buyer decline is the key
